SPORTS ACT - 1976 (SMCD 54)

(1) There is hereby established a Council to be known as "the National Sports Council", in this Decree referred to as "the National Council."
(2) The National Council shall be a body corporate, have perpetual succession, have a common seal which shall be officially and judicially noticed, and may sue and be sued in its corporate name.
(3) The National Council may, for, and in connection with the carrying out of its objects and functions under this Decree, purchase, hold, manage or dispose of any movable or immovable property and may enter into such contracts and transactions as may be expedient.

Where there is any hindrance to the acquisition of any property under subsection (3) of section 1 of this Decree, the property may be acquired for the National Council under the State Property and Contracts Act, 1960 (CA 6) or, as the case may be, under the State Lands Act, 1962 (Act 125), and each such Act shall, as the case may be, apply with respect to any such acquisition, with such modifications as may be necessary to provide for the vesting of the property acquired thereunder in the National Council and for the cost of the acquisition to be defrayed by the National Council.

The objects of the National Council are -
(a) to promote and encourage the organisation and development of, and mass participation in, amateur and professional sports in Ghana;
(b) to co-ordinate and integrate all efforts to raise the standards of performance in amateur and professional sports throughout Ghana.

(1) Without prejudice to the generality of the provisions of section 3 of this Decree, the National Council shall, for the purposes of giving effect to its objects -
(a) organise and assist financially or otherwise the participation of Ghanaian sportsmen and sportswomen in amateur and professional sports at District, Regional, National and International levels;
(b) be responsible for taking insurance cover for all sportsmen, sportswomen and sports officials chosen to represent Ghana in or outside Ghana in respect of such risks as appear to the National Council to be reasonable and incidental to sports;
(c) provide such financial and other assistance as the Commissioner responsible for Sports (in this Decree referred to as "the Commissioner") may consider reasonable to any team or person for the purpose of enabling that team or person to represent Ghana in International competitions in or outside Ghana;
(d) encourage Ghanaians to participate in sporting activities in or outside Ghana;
(e) provide sports instructors to any team, person or organisation who or which in the opinion of the National Council, reasonably needs such instructors;
(f) provide and maintain sports centres and facilities for use by all sportsmen and sportswomen;
(g) maintain all playing fields and stadia provided by the body known as the National Playing Fields Board or any other body approved by the Commissioner;
(h) promote the establishment of both amateur and professional association of sports at the District, Regional and National levels;
(i) provide financial assistance to all such sporting associations as appear to the National Council to be deserving of such assistance;
(j) provide the Regional Sports Council with such financial and other assistance as the National Council may consider necessary to enable them to promote, encourage and develop sports effectively in their respective regions;
(k) provide the Universities in Ghana, the Armed Forces, the Police Force, the Prisons Service, Schools and Colleges financial and other assistance for the holding of special sports festivals;
(l) undertake and encourage research into all matters relating to sports;
(m) do all other acts as are reasonably incidental or conducive to the attainment of the objects of the National Council.
(2) The National Council shall, in all international relations affecting amateur or professional sports or both, have the sole right to make on behalf of the Regional Sports Councils and National Sports Associations, any necessary arrangements for competitions, technical assistance and recruitment of coaches.
(3) Such arrangements shall be concluded through the Ministry responsible for Sports and the appropriate Government agency.

No person shall be qualified to be a member of the National Council-
(a) if he has been sentenced to death or to a term of imprisonment exceeding twelve months without option of a fine or has been convicted of an offence involving dishonesty or moral turpitude and has not in each case been granted a free pardon;
(b) if having been declared as an insolvent or a bankrupt under any law for the time being in force in Ghana or any other country he is an undischarged insolvent or bankrupt;
(c) if he is adjudged to be a person of unsound mind; or
(d) if in the case of a person possessed of professional qualifications he is for the time being disqualified or suspended otherwise than at his own request from practising his profession in Ghana or in any other country by order of any competent authority made in respect of him personally; so however that a person shall not be deemed to be disqualified from being a member under this paragraph of this section by virtue of his disqualification from practising his profession, if five years have passed since such disqualification.

(1) Members of the National Council other than the Executive Chairman and the representative of the Ministry responsible for Sports, shall hold office for a period of two years.
(2) Any such member may resign his office by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.
(3) Any person who is a member of the National Council by virtue of paragraph (b) or (d) of section 5 of this Decree, shall cease to be a member upon his nomination being cancelled by the authority responsible for his nomination to the National Council, by writing addressed to the Executive Chairman, who shall forthwith communicate such information to the Commissioner.
(4) Any member of the National Council other than the Executive Chairman, may be removed by the Commissioner from such membership if the Commissioner is satisfied that it is in the public interest so to do.
(5) Where the office of a member of the National Council other than that of the Executive Chairman becomes vacant for any reason before the expiry of his term of office (if any), the Executive Chairman shall notify the authority responsible for his appointment or nomination of such vacancy and shall also, if the Commissioner is not that authority, notify the Commissioner thereof.
(6) Where any such vacancy occurs, the Commissioner or such other authority may appoint or nominate as the case may be, a person to fill the vacancy.
(7) Any person so appointed or nominated other than a person nominated under paragraph (b) of section 5 of this Decree, shall hold office for the unexpired portion of the previous holder's term of office.
(8) Where any member of the National Council is incapacitated by reason of his absence from Ghana or illness or any other sufficient cause from the performance of the duties of his office, the Executive Chairman shall forthwith notify such information to the authority responsible for the appointment or nomination of that person and that authority may appoint or nominate another person to act in the place of that member until his incapacity has terminated or until the expiry of his term of office whichever first occurs.
(9) Subject to the provisions of this Decree, where the offices of Chief Executive and Executive Chairman are vacant or if the Executive Chairman and Chief Executive is for any reason unable to perform the functions of these offices, the Chief Administrative Officer referred to in section 29 of this Decree shall act in both offices until the vacancy in the office of Chief Executive is filled or until the first mentioned officer is able again to perform those functions.
(10) Subject to the provisions of this Decree, any person ceasing to hold office as a member shall be eligible to be re-appointed or re-nominated as the case may be to the National Council.

(1) The National Council shall meet for the dispatch of business at such times, and places as the Executive Chairman may appoint but shall meet at least once in every month.
(2) The Executive Chairman shall, if present, preside at every meeting of the National Council and in his absence the Chief Administrative Officer shall preside and, in the absence of both of them, a person elected by the members of the National Council present from among their number shall preside.
(3) The quorum at any meeting of the National Council shall be seven.
(4) Questions proposed at any meeting of the National Council shall be determined by a simple majority of members present and voting and, in the event of an equality of votes, the person presiding shall have a second or casting vote.
(5) The National Council may at any time co-opt any person or persons to act as an adviser or advisers at any of its meetings; so however, that no person so co-opted shall be entitled to vote at any such meeting on any matter for decision by the National Council.
(6) The validity of any proceedings of the National Council shall not be affected by any vacancy among its members or any defect in the appointment or nomination of any of them.
(7) Any member of the National Council who has any interest in any company or undertaking with which the National Council proposes to enter into a contract or has any interest in any contract which the National Council proposes to enter into shall disclose in writing to the National Council the nature of his interest and shall be disqualified from participating in any deliberations of the National Council on the contract and from voting in any decision of the National Council on the contract.
(8) Any member of the National Council who infringes subsection (7) of this section shall be liable to be removed from the National Council.

(1) Any member of the National Council other than the Executive Chairman, as well as any person co-opted under subsection (5) of section 8 of this Decree, and also, any member of a Committee of the National Council may be paid such remuneration as the Commissioner and the Commissioner responsible for Finance may approve in relation to him.

(1) The Assembly shall comprise the following members -
(a) the Executive Chairman who shall be Chairman of the Assembly;
(b) all persons who are members of the National Council by virtue of paragraphs (b), (c) and (d) of section 5 of this Decree;
(c) the Chairman or a representative of the body known as the National Olympic and International Games Fund Raising Committee;
(d) one representative of each Regional Sports Council;
(e) the Chairman or a representative of the National Amateur Sports Association of each prescribed sport;
(f) one representative of each prescribed institution;
(g) a representative of the Ministry responsible for Education who shall be the Head of the Sports Division of that Ministry; and
(h) a representative of the National Professional Sports Association of each prescribed professional sport.
(2) In this section -
"prescribed institution" means the Prisons Service, each of the Universities in Ghana, the Physical Education Association, the Sports Medical Association, the National Youth Council and such other institution as may be prescribed by the Commissioner by regulations made under section 42 of this Decree;
"prescribed professional sport" means professional boxing, professional golf, horse racing and any other professional sport prescribed by the Commissioner by regulations made under section 42 of this Decree; and
"prescribed sport" means soccer, boxing, athletics, cricket, volley-ball, basket-ball, lawn tennis, table tennis, swimming, hockey, golf, squash, handball, cycling, gymnastics, judo, chess, weight-lifting, shooting, wrestling and such other sport as may be prescribed by the Commissioner by regulations made under section 42 of this Decree.

The Assembly shall be an advisory, consultative and deliberative body and shall have the following functions:-
(a) to consider and discuss such matters relating to sports as the National Council may submit to it and to give advice to the National Council on such matters, making such proposals as the Assembly may consider appropriate;
(b) to give its opinion on such matters relating to sports as the Commissioner may refer to it through the National Council;
(c) to submit such proposals as it may consider appropriate to the National Council on any matter relating to Sports.

(1) All members of the Assembly other than the following shall hold office for twelve months:-
(a) the Executive Chairman;
(b) any person who is a member of the Assembly by virtue of paragraph (b) of subsection (1) of section 12 of this Decree;
(c) the representative of each Regional Sports Council; and
(d) the representative of the Ministry responsible for Education.
(2) Any member of the Assembly other than the Executive Chairman, the representative of the Ministry responsible for Sports and the representative of the Ministry responsible for Education may resign his office by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.
(3) Any person who holds office as a member by virtue of nomination by any authority or body shall cease to hold such office upon his nomination being cancelled by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.
(4) If it appears to the Assembly that a member of the Assembly other than the Executive Chairman or a person who is a member by virtue of paragraph (b) of subsection (1) of section 12 of this Decree should be removed from office on the ground of misconduct or inability to perform the functions of his office, the Assembly may, after consultation with the authority or body responsible for his nomination to the Assembly, make a recommendation to that effect to the Commissioner.
(5) Where the Commissioner is satisfied with a recommendation made to him under subsection (4) in respect of any member to whom that section relates, or if he is otherwise satisfied (whether a recommendation has been made in respect of him or not) that any such member should be removed from office in the public interest, he may remove him from such office.
(6) Where the office of a member of the Assembly other than the Executive Chairman becomes vacant for any reason before the expiry of his term of office (if any) the Executive Chairman shall notify the authority or body responsible for his nomination of such vacancy and also the Commissioner.
(7) Where any such vacancy occurs the authority or body responsible for the nomination of a person in place of the previous holder may nominate a person to fill such vacancy.
(8) Any person so nominated shall hold office for the unexpired portion of the previous holder's term of office.
(9) Where any member of the Assembly other than the Executive Chairman or any person who is a member of the Assembly by virtue of paragraph (b) of subsection (1) of section 12 of this Decree is incapacitated by reason of his absence from Ghana or illness or any other sufficient cause from the performance of the duties of his office, the Executive Chairman shall forthwith notify such information to the authority or body responsible for the nomination of such person and such authority or body may nominate another person to act in the place of that member until his incapacity has terminated or until the expiry of his term of office, if any, whichever first occurs.
(10) For the removal of doubts -
(a) where any person who is a member of the National Council as well as a member of the Assembly ceases to be a member of the National Council or ceases for the time being to act as such, he shall also cease to be a member of the Assembly or to act as such until such time as he again becomes a member of the National Council or resumes acting as such; and
(b) any person appointed or nominated to replace him or to act for him or required by this Decree to act for him on the National Council shall be a member of the Assembly in his place or, as the case may be, act in his place on the Assembly until such time as the substituted person ceases to be a member of the National Council or ceases so to act under section 7 of this Decree.
(11) Subject to the provisions of this Decree, any person ceasing to hold office as a member of the Assembly shall be eligible to serve again as a member of the Assembly.

(1) The Assembly shall meet for the despatch of business at such times and places as the Executive Chairman may appoint but shall meet not less than four times in a year.
(2) The Executive Chairman shall, upon the written request of the Commissioner or upon the request in writing of not less than ten members of the Assembly, including not less than four representatives of Regional Sports Councils, convene a special meeting of the Assembly to transact any extraordinary business on a date specified in the request.
(3) Where any such request is made by members other than the Executive Chairman, the request shall be transmitted to the Executive Chairman with a summary of the business to be transacted at least twenty-one days before the date on which the meeting is expected to be held.
(4) Particulars of the business to be transacted at any meeting of the Assembly shall be circulated to members with the notice of the meeting.
(5) The quorum at any meeting of the Assembly held under subsection (1) of this section shall be fifteen and the quorum at any meeting of the Assembly held under subsection (2) of this section shall be ten including not less than four representatives of Regional Sports Council.
(6) The Executive Chairman if present shall preside at every meeting of the Assembly and in his absence the Chief Administrative Officer shall preside, and, in the absence of both of them a person elected by members of the Assembly present from among their number shall preside.
(7) Every question proposed at a meeting of the Assembly shall be decided by a simple majority of members present as determined by acclamation or by voting.
(8) The Executive Chairman, or other person presiding at a meeting of the Assembly shall, in the case of an equality of votes, have a second or casting vote.
(9) The Assembly may at any time co-opt any person or persons to act as an adviser or advisers at any of its meetings, so however that no person so co-opted shall be entitled to vote at any such meeting on any matter for decision by the Assembly.
(10) The validity of any proceeding of the Assembly shall not be affected by any vacancy among its members or by any defect in the appointment or nomination of any of them.
(11) Subject to the provisions of this section and the provisions of any regulations made under section 42 of this Decree, the Assembly may regulate its own procedure and the procedure of its committees.

(1) Members of the Assembly shall be paid no remuneration for acting as members of the Assembly, but may be paid such travelling and other allowances as may be approved by the Commissioner and the Commissioner responsible for Finance in relation to them.
(2) Members of the committees of the Assembly and persons co-opted under subsection (9) of section 16 or under subsection (2) of section 17 of this Decree may be paid such allowances as the Commissioner and the Commissioner responsible for Finance may approve in relation to them.

The functions of each Regional Sports Council shall be -
(a) to promote, encourage and develop sports throughout its Region;
(b) to co-ordinate all sporting activities of the District Sports Council within the Region;
(c) to advise the District Sports Councils on the provision of their financial requirements in the annual estimates of the National Council and serve as the channel for the issue of such moneys to the District Sports Councils;
(d) to prepare and submit to the National Council at such times and in such form as the National Council may prescribe, annual estimates of income and expenditure in respect of sports in the Region based on estimates submitted by the District Sports Council within its Region;
(e) to co-ordinate the activities of the District Sports Councils within the Region in relation to the care and maintenance and provision of sports facilities in the Region;
(f) to prepare and submit to the National Council returns on sporting activities in the Region at such times and in such form as the National Council may prescribe; and
(g) to exercise such other functions as the National Council may assign to it.

(1) All members of a Regional Sports Council other than the Regional Commissioner or his representative and the Executive Secretary shall hold office for a period of twelve months.
(2) Any such member may, by writing addressed to the Chairman of the Council and copied to the Executive Secretary, resign his office.
(3) The Regional Commissioner may, after consultation with the District Sports Council which nominated him (if any) by writing addressed to any such member and copied to the Executive Secretary, remove him from office on stated grounds of misconduct or inability to perform the functions of his office.
(4) Any person ceasing to hold office as a member of a Regional Sports Council shall be eligible to serve again on a Regional Sports Council.

(1) All members of a District Sports Council other than the District Chief Executive or his representative and the Executive Secretary shall hold office for a period of twelve months.
(2) Any such member may by writing addressed to the Chairman of the Council and copied to the Executive Secretary resign his office.
(3) The District Chief Executive may, after consultation with the Executive Secretary, by writing addressed to any such member and copied to the Executive Secretary, remove him from office on stated grounds of misconduct or inability to perform the functions of his office.
(4) Any person ceasing to hold office as a member of a District Sports Council shall be eligible to serve again on a District Sports Council.

There shall be established a Secretariat of the National Council headed by the Chief Executive appointed under section 29 of this Decree through which, subject to the provisions of this Decree, the day-to-day administration of the affairs of the National Council shall be carried out.

(1) There shall be an officer of the National Council to be known as the Chief Executive.
(2) The Chief Executive shall be appointed by the Supreme Military Council upon the recommendations of the Commissioner and shall hold office upon such terms and conditions as shall be stated in his instrument of appointment.
(3) The National Council shall also have the following officers:-
Chief Administrative Officer,
Chief Sports Organiser,
Deputy Chief Sports Organiser, and
Chief Accountant.
(4) The Commissioner acting on the recommendation of the Chief Executive shall be responsible for the appointment, promotion, discipline, dismissal and removal of any person in respect of each of the posts referred to in subsection (3) of this section, so however that, unless a person is being seconded from any part of the public service to fill a vacancy in any such post, or unless in a case where a person is being promoted into any such post from among the employees of the National Council the Commissioner directs that there should be no advertisement, a person to be recommended by the Chief Executive for appointment into any such post shall be a person selected by interview as a result of an advertisement of the vacancy indicating the minimum qualifications required for such appointment.
(5) Such officers shall, subject to subsection (4) of this section, hold office upon such terms and conditions as the National Council may determine.
(6) The National Council shall also engage such other employees as may be expedient for the proper and efficient conduct of the business and functions of the National Council and on such terms and conditions as the National Council may determine.
(7) Subject to the provisions of this Decree, the National Council shall have the power to appoint, promote, discipline, dismiss or remove the employees referred to in subsection (6) of this section.
(8) The National Council may also engage the services of such consultants and advisers as the National Council may on the recommendation of the Chief Executive determine.

(1) The Chief Executive shall, subject to such directions on matters of general policy as may be given from time to time by the National Council, be responsible for-
(a) the day-to-day direction of the business of the National Council;
(b) the implementation of the policy decisions of the National Council;
(c) the organisation and control of the employees of the National Council including transfers and postings of such employees and the maintenance of efficiency among such employees;
(d) liaising between the National Council, the Assembly and the Commissioner with a view to ensuring effective implementation of this Decree;
(e) the exercise of the powers of the National Council under subsection (7) of section 29 of this Decree and the power of the Council to engage consultants and advisers under subsection (8) of that section;
(f) the performance of such other functions as the National Council may assign to him.
(2) In the discharge of his functions under paragraph (e) of subsection (1) of this section the Chief Executive shall be assisted by a committee of the National Council appointed under section 9 of this Decree.

(1) Except at any time when he is acting as Executive Chairman and Chief Executive in place of the substantive holder of these posts, the Chief Administrative Officer shall act as Secretary to the National Council and the Assembly.
(2) As Secretary he shall, subject to the directions of the National Council or the Assembly as the case may be, arrange the business for and cause to be recorded and kept minutes of all meetings of the National Council or the Assembly as the case may be.
(3) The minutes of the National Council and the minutes of the Assembly shall each be recorded and kept separately in a register and signed by the person presiding at the meeting in respect of which the minutes were recorded.
(4) As Secretary the Chief Administrative Officer shall also perform such functions as the National Council and the Assembly may direct or as the Chief Executive may by writing direct and shall be assisted in his functions under this section by such employees of the National Council as the Chief Executive may direct.

(1) The funds of the National Council shall include-
(a) any grants received from the Government by the National Council for the discharge of its objects and functions;
(b) any loans granted to the National Council by the Government or any banking institution;
(c) any money accruing to the National Council in the course of the performance of its objects and functions under this Decree including proceeds of matches and competitions, and
(d) gifts.
(2) All moneys received by or on behalf of the National Council shall be deposited to the credit of the National Council in a bank approved by the National Council.

(1) The National Council may obtain loans and other credit facilities from such banks as the Commissioner and the Commissioner responsible for Finance may approve.
(2) Without prejudice to subsection (1) of this section the National Council may, with such approval borrow from any other source whether temporarily by way of overdraft or otherwise.
(3) The Commissioner responsible for Finance may on behalf of the Government guarantee the performance of any obligation or undertaking of the National Council under this section and may from time to time prescribe the maximum sums which the National Council may borrow under this section.
(4) Any moneys falling due to be paid by the Government under a guarantee provided under this section are hereby charged on the Consolidated Fund.

(1) The National Council shall, not later than two months before the end of each financial year, cause to be prepared and submitted to the Commissioner and the Commissioner responsible for Finance for the approval of the Government an annual budget or financial plan in respect of the ensuing financial year comprising estimates of expected recurrent, development and capital expenditure of the National Council in the said financial year.
(2) The budget or financial plan shall be in such form as the Commissioner and the Commissioner responsible for Finance may approve.
(3) After the budget or financial plan has been approved by the Government the Chief Executive shall ensure that the moneys approved therein are not used otherwise than as so approved without the approval of the Commissioner responsible for Finance.

(1) The National Council shall establish a board to be known as the Finance and Economics Board.
(2) The Board shall consist of five persons appointed by the National Council and may comprise members of the National Council or others or both.
(3) The Board shall be responsible generally for the proper administration of the finances of the National Council and shall, in particular-
(a) study the current and long-term financial requirements of the National Council and advise on how grants and moneys provided by the Government to the National Council should be used in the best interests of sports in Ghana;
(b) work out a financial policy for the disbursement of finance to all the national associations of sports or groups of sports;
(c) advise on the best way of organising the importation and sale of sports equipment in Ghana;
(d) keep under constant review the finances of the National Council and keep the National Council informed as to the state of its finances;
(e) to perform such functions as the National Council may assign to it.

(1) The National Council shall keep proper books of accounts and proper records in relation thereto.
(2) The National Council shall cause to be prepared an annual statement of accounts in such form and containing such particulars as the Auditor-General may from time to time direct.
(3) The books and accounts of the National Council shall be audited each year by the Auditor-General.
(4) The Auditor-General shall, not later than the 30th day of September in each year, forward to the Commissioner a copy of the audited accounts of the National Council for the financial year immediately preceding and his report thereon.
(5) The report of the Auditor-General shall state whether in his opinion -
(i) proper books of accounts have been kept by the National Council;
(ii) the financial statement of the National Council was prepared on a basis consistent with that of the preceding year and is in agreement with the books of accounts of the National Council.
(6) The Auditor-General shall in his report call the attention of the Commissioner to any matter falling within the scope of his examination which in his opinion should be brought to the attention of the Supreme Military Council.
(7) The Commissioner shall as soon as practicable on receiving the report cause it to be laid before the Supreme Military Council.

(1) The National Council shall, as soon as possible after the expiration of each financial year, but within six months after the expiration of that financial year, submit to the Commissioner an annual report dealing generally with the activities and operations of the National Council and the implementation generally of the provisions of this Decree within that year.
(2) Without prejudice to the generality of subsection (1) of this section, the annual report shall include -
(a) such information with regard to the proceedings and policy of the National Council and the proceedings of the Assembly within the year as the National Council may consider appropriate;
(b) the audited accounts of the National Council together with the Auditor-General's report thereon;
(c) reports submitted in relation to that year by the Internal Auditor under section 32 of this Decree;
(d) such other information as the Commissioner may by writing request.
(3) Copies of the annual report shall be forwarded to the Commissioner responsible for Finance, the State Enterprises Commission and the Government Statistician.
(4) The Commissioner shall as soon as possible, after receiving the annual report, submit it to the Supreme Military Council.
(5) The National Council shall also submit to the Commissioner such other reports concerning the implementation of this Decree as the Commissioner may, in writing, reasonably request from time to time.

(1) The Commissioner may by legislative instrument, make such regulations as appear to him to be expedient for the purpose of giving full effect to the principles contained in this Decree.
(2) Without prejudice to the generality of subsection (1) of this section, regulations made thereunder may-
(a) make provision relating to the establishment, composition and functions of sports associations, whether National, Regional or District and whether amateur or professional, and may make different provisions for different associations;
(b) provide for the take-over and management by the National Council temporarily of the affairs of any sports association for the purpose of ensuring efficient and proper management of the affairs of the association;
(c) provide for the issue of licences in respect of any matter relating to sports and provide for fees to be charged in relation to such licences;
(d) require the maintenance of a depreciation fund or staff welfare fund or both;
(e) provide for the establishment of a welfare fund for sportsmen or sportswomen or any group of them, and provide for the provision of moneys for such fund including, if the Commissioner thinks fit, the payment into it of a percentage of the gate takings of any particular sport, and
(f) prescribe as a penalty for the infringement of any provision of the regulations a fine not exceeding c2,000.00 or a term of imprisonment not exceeding twelve months or both.

(1) The National Council may subject to any regulations made by the Commissioner under section 42 of this Decree and to any other enactment, make bye-laws or other instruments for the purpose of regulating any matter falling within the scope of the objects and functions of the National Council.
(2) Without prejudice to the general effect of subsection (1) of this section, the National Council may, subject to the Social Security Decree, 1972 (NRCD 127) make bye-laws or other instruments under that subsection for providing for the conditions of service of the staff of the National Council including, if the National Council thinks fit, the operation of a contributory provident fund.

(1) The Sports Council of Ghana Decree, 1969 (NLCD 330) and the Ghana Boxing Board of Control Decree, 1969 (NLCD 362) are hereby repealed and the Sports Council of Ghana and the Ghana Boxing Board of Control existing respectively under the enactments immediately before the commencement of this Decree, are hereby dissolved.
(2) All property, rights, assets, obligations and liabilities of the said Ghana Sports Council and Ghana Boxing Board of Control are hereby transferred to the National Council.
(3) Without prejudice to the general effect of subsection (2) of this section, all employees of the Ghana Sports Council and the Ghana Boxing Board of Control are hereby transferred to the employment of the National Council.
(4) Without prejudice to the general effect of subsection (3) of this section-
(a) the person holding office immediately before the publication of this Decree in the Gazette as Director of Sports and Chief Executive of the Sports Council of Ghana shall be deemed to have been duly appointed Chief Executive and Executive Chairman under this Decree;
(b) any person holding the office of Chief Administrative Officer, Chief Sports Organiser, Deputy Chief Sports Organiser or Chief Accountant of the Sports Council of Ghana immediately before the publication of this Decree in the Gazette shall be deemed to have been duly appointed to the corresponding post under this Decree;
(c) any person holding office as Regional Sports Organiser, Deputy Regional Sports Organiser or Sports Development Officer of the Sports Council of Ghana immediately before the publication of this Decree in the Gazette shall be deemed to have been duly appointed to the corresponding post under this Decree.

In this Decree, unless the context otherwise requires -
"Commissioner" means the Commissioner responsible for Sports;
"District" means the area of authority of a District Council;
"prescribed institution", "prescribed professional sport" and "prescribed sport" have the meanings respectively assigned to them in section 12 of this Decree;
"Region" includes the area generally known as the Greater-Accra Region.
