NATIONAL YOUTH COUNCIL ACT - 1974 (NRCD 241)

(1) There is hereby established a body to be known as the National Youth Council hereafter in this Decree referred to as "the Council".
(2) The Council shall be a body corporate with perpetual succession and a common seal and may sue and be sued in the name assigned to it by this Decree.
(3) The Council may, except as otherwise directed in writing by the Commissioner, for the purpose of carrying out its object, purchase, hold, manage and dispose of any movable or immovable property and may enter into such contracts and other transactions as may be expedient.

(1) The object of the Council is to develop a strong and disciplined youth imbued with a spirit of nationalism and a sense of public service and morality.
(2) In furtherance of the object mentioned in subsection (1) of this section the Council shall be charged with the responsibility for the formulation of such policies and programmes as will promote in the youth-
(a) a sense of self-reliance, leadership, discipline and civic responsibility;
(b) a sense of friendship and co-operation through exchange of ideas with youth organisations in other countries in Africa and the world.

(1) The governing body of the Council shall be a board of trustees in this Decree referred to as "the Board"
(2) The Board shall consist of the following persons:-
(a) a chairman;
(b) a deputy chairman;
(c) the National Co-ordinator;
(d) ten members of the public nominated by the Commissioner;
(e) a representative of the Ministry of Education (ex officio);
(f) a representative of the Ministry responsible for Youth Affairs (ex officio);
(g) a representative of the Department of Social Welfare and Community Development (ex officio).
(h) a representative of the National Union of Ghana Students. [As inserted by National Youth Council (Amendment) Decree, (NRCD 300)].
(3) The Chairman, the Deputy Chairman and other members of the Board other than the National Co-ordinator shall be appointed by the National Redemption Council on the advice of the Commissioner.
(4) The members of the Board other than the National Co-ordinator and the ex officio members shall hold office for a period of three years but such members may be eligible for re-appointment at the expiration of their term of office.
(5) Members of the Board other than the ex officio members may resign their office by notice in writing addressed to the Commissioner and the appointment of any such member may at any time be terminated by the National Redemption Council if the Council is satisfied that it is in the public interest so to do.
(6) Members of the Board may be paid such remuneration or allowance as the Commissioner in consultation with the Commissioner responsible for Finance may determine.

(1) Subject to the other provisions of this Decree, the Board shall have general control of the management of the Council on matters of policy.
(2) Without prejudice to subsection (1) of this section the Board shall, on behalf of the Council, be responsible for the efficient functioning and co-ordination of the activities of youth organisations in Ghana and for the formulation of policies and programmes in respect of all youth activities and also generally for the carrying out the object of the Council.

(1) An ordinary meeting of the Board shall be held at least once in every four months and shall be convened by the Chairman in consultation with the National Co-ordinator.
(2) An extra-ordinary meeting of the Board may be summoned at the request of not less than two-thirds of the members of the Board, and no business shall be transacted other than that stated in the agenda for that meeting.
(3) Notice of every ordinary meeting of the Board shall be given to each member of the Board at least 14 days prior to the date of the meeting.
(4) The Chairman, the National Co-ordinator and not less than one-third of the other members of the Board shall constitute a quorum at any meeting of the Board.
(5) The Chairman shall preside at every meeting of the Board and in his absence the Deputy Chairman shall preside and in the absence of both of them any member elected by the members of the Board present shall preside.
(6) Questions proposed at meetings of the Board shall be determined by a simple majority of the members present and voting and in the event of equality of votes the Chairman or the person presiding shall have a second or casting vote.
(7) The validity of any proceedings of the Board shall not be affected by any vacancy among its members or by any defect in their appointment.
(8) The Board may at any time co-opt any person to act as an adviser at any of its meetings but no person so co-opted shall be entitled to vote at such meetings.
(9) The Board may appoint such committees as it may think fit to assist in the discharge of its functions.

(1) There shall be appointed in each region a Regional Youth Committee comprising the following persons:-
(a) a chairman appointed by the Commissioner;
(b) one person appointed by the Chairman of the Council;
(c) a Regional Co-ordinator appointed by the Commissioner;
(d) one representative from each of the Youth groups mentioned in subsection (1) of section 9;
(e) the Regional Education Officer (ex officio);
(f) the Regional Social Welfare and Community Development Officer (ex officio).
(2) The Regional Youth Committees shall assist the Council in carrying out its functions and shall, subject to the directions of the Board, be responsible for the implementation of the policies of the Council in the Regions.
(3) A Regional Youth Committee shall meet at such times and places as the Chairman may determine but not less frequently than once in every three months.
(4) A Regional Youth Committee may prescribe its own procedure for the conduct of its meetings.

(1) There shall be appointed in each district a District Youth Committee which shall consist of-
(a) a chairman appointed by the Commissioner;
(b) a District Co-ordinator appointed by the Commissioner;
(c) the District Education Officer (ex officio);
(d) the District Social Welfare and Community Development Officer (ex officio).
(2) A District Youth Committee shall, subject to the directions of the Regional Youth Committee, be responsible for the organisation of all youth activities in the district.
(3) A District Youth Committee shall meet at such times and places as the Chairman may determine but not less frequently than once in every three months.
(4) A District Youth Committee shall regulate its own procedure for the conduct of its meetings.

(1) The Council shall have a National Co-ordinator who shall be appointed by the National Redemption Council upon such terms and conditions as may be specified in his instrument of appointment.
(2) The National Co-ordinator shall be a public officer.
(3) The National Co-ordinator shall, subject to the general control of the Board on matters of policy, be charged with the direction of the day-to-day business of the Council and of the administration, organisation and control of all the employees of the Council.
(4) Where the office of the National Co-ordinator becomes vacant the Board shall notify the Commissioner who in turn shall notify the National Redemption Council.
(5) Where the National Co-ordinator is unable by reason of illness or absence from Ghana to perform his functions under this Decree the Board shall authorise one of the Deputy National Co-ordinators to perform those functions until such time that he is able again to perform those functions.

(1) The Council shall have four Deputy National Co-ordinators who shall be in charge of the Religious, Adventure, Student and Settlement groups of the Council.
(2) The Deputy National Co-ordinators shall be public officers and shall be appointed by the Commissioner on such terms and conditions as he may determine.
(3) Subject to the directions of the National Co-ordinator on matters of policy a Deputy National Co-ordinator shall be responsible for organising the activities and programmes of the youth group mentioned in relation to him in subsection (1) of this section.

(1) No youth organisation shall engage in any youth activities unless that organisation has been registered as such by the Council.
(2) The Council shall charge in respect of every registration such fee as the Board may determine with the prior approval of the Commissioner.
(3) Notwithstanding the provisions of any enactment any youth organisation in existence immediately before the commencement of this Decree shall within thirty days after the coming into force of this Decree apply to the Council to be registered.
(4) Any youth organisation which fails to register within thirty days after its formation or if in existence before the coming into force of this Decree, fails to register within thirty days after the Decree had come into force shall be proscribed by the Council and it shall be unlawful for any person to do any act likely to promote the activities and operations of any youth organisation so proscribed.
(5) Any person who does any act in contravention of sub-section (4) of this section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding c500.00 or to imprisonment for a term not exceeding six months or to both.
(6) The Council shall proscribe or refuse to register any youth organisation the aims or objects of which are contrary to the object of the Council.

In this Decree-
"board" means the Board appointed under section 3 of this Decree;
"commissioner" means the Commissioner responsible for Youth Affairs;
"district" has the meaning assigned to it by section 119 of the Local Administration Act, 1971 (Act 359) so however that where a District Council has not been established in any area "district" shall in respect of that area mean an administrative district.
