ADMINISTRATION OF ESTATES ACT - 1961 (ACT 63)Section - 42 - Distribution of proceeds of estateAs soon as may be after the expiration of the time limited for the submission of claims in the last of the notices published in pursuance of section 28 of this Act, or after the settlement of any disputed claim, the Administrator-General shall dispose of the property of the estate in the manner following (a) he shall reimburse himself of all such costs and charges as he may reasonably have incurred in collecting the estate; (b) he shall pay to the credit of the Consolidated Fund out of the gross amount of moneys arising from the realisation of the estate such percentage thereof as may be prescribed; (c) he shall pay the creditors of the estate in the order and manner provided by law; and (d) he shall pay or distribute the balance (if any) which remains after such payments aforesaid to the persons legally entitled thereto, if known or, if unknown, to the Accountant-General in trust for the persons entitled thereto, in accordance with section 45 of this Act. |
